Apologies made by 12 websites

The regular meeting of Ethics Committee of Newspapers, magazines and sites of the Media Council of Mongolia was held on November 30th of 2017 and undertaken respective actions by considering complaints of 5 individuals and 2 organizations that blamed 27 websites and one newspaper for 20 publications.   

Complaint #1:

The  Specialized  inspection  agency of Ulaanbaatar city /CSIA/ has complained to MMC on 2 publications of “Zarig.mn” website which was  titled   as  “Specialized  inspection  agency of Ulaanbaatar city – EMPTY ”  dated   on July 27th of 2017 and  “ L.Erdenechuluun, Head of CSIA has claimed 20 million tug from a journalist” dated  on September 11th of 2017. The complaints stated  that the agency considers the publications as obvious libels against a vice head and heads of divisions who were on official duties and  by saying as “the public agency was not working during the business time by its full staff composition”,  it has  created discredits  among  the public,  provided  facts with no-accuracy, and damaged  reputation of a legal entity by abusing journalist’s  professional merits, and re-publicized misinformation with intention to defend their fault instead of correcting inaccuracy.   

The Committee has considered the complaint and concluded that “Zarig.mn” website has not undertaken insight examination of its publications, not verified the accuracy, and not undertaken any actions to correct the inaccuracy though it has admitted the inaccuracy of its publications. Therefore Zarig.mn website has breached provisions of Paragraph 1.1. “Provision of the public with accurate information,   preferment of humanness and dignity are supreme values of journalistic media. Insight examination of information is a basic principle of accurate journalism”, Paragraph 1.1 “Avoid any accidental errors by verifying the accuracy of information” and Paragraph 1.9 “Undertake prompt corrections of information if they have been identified as misinformation”, The Code of Media Ethics.

Complaint #2.

B.Purev-Ochir, an individual has made a complaint to MMC as information websites such as “Dorgio.mn and “Zaluu.mn” have harmed  reputation of Boxing union of Mongolia, and caused psychological disruption  and reputation damage   through inaccurate publication dated on July 21st of 2017 which was titled as  “Has  B.Purev-Ochir , a boxing  trainer harassed a female trainee” .  The MMC identified that the respective websites published the information based  on one  side  source without approaching B.Purev-Ochir,  an individual  for justification or explanation,  and therefore it’s been  concluded that the websites have breached a provision of Paragraph 1.8 “ Blamed or questioned party shall be allowed for justification or explanation”, the Code of Media Ethics.

Complaint #3:

T.O, an individual  made a complaint to MMC blaming “Factnews.mn” website  for  misusage of  slander, libel and dissemination  a false information through its  publication  that “ T.O, a model criticized a pigeon who is to attend a World miss competition as  “repaired”. The Committee considered the complaint and concluded that the website has not undertaken insight examination of information and has not verified the source of information by breaching provisions of Paragraph 1.1  “ Avoid any accidental errors by verifying  accuracy of information” and Paragraph 1.2 “ Prefer quoting a source of information by investigating verification of the source.”, The Code of Media Ethics. 

Complaint #4:

B.A, an individual has made a complaint to MMC blaming “Breakingnes.mn” an information website for deliberate insulting intention and serious damages to his reputation, family and personal values through 4 series of publications from 18th to 23rd of May, 2017.  The Committee considered the complaint  and identified that the respective website has not undertaken insight examination for   disclosing the case  to the public,  has not examined the accuracy, has not mentioned as it’s been an assumption and in regard with B.A, an individual, has not provided him with an equal chance for explanation by infringing his  privacy through  2 publications titled as    “ Pair winner with harmonized interests  and personality”  dated on May 18th, 2017 and “Does G.Batbayar, a lawyer produce his  interviews  with his name-pinned   girlfriend?”.  Therefore it’s been concluded that the respective website has infringed  provisions of Paragraph 1.1  “Avoid any accidental errors by verifying  accuracy of information”, Paragraph 1.6 “ unverified information, assumption and gossip shall be clearly  mentioned as an “assumption”, Paragraph 1.8 “Blamed or questioned party shall be allowed for justification or explanation” and Paragraph 6.2 “Respective identification of a person including  name, photo and other privacy concerned information shall be disclosed only for the  benefits and concerns of the public”,  The Code of Media Ethics

Complaint 5:

B.A, an individual has made a written complaint to MMC blaming almost 20 websites including  paparatsi.mn, breakingnews.mn, zindaa.mn, ugluu.mn, khoshinshog.mn, nutag.mn, zaluu.mn, fact.mn, new.mn, chuham.mn, criminal.mn, shudarga.mn, arkhangai.mn, erdenetmedee.mn, darkhannews.mn, dundgovi.mn, mongolcomment.mn, undesten.mn, duulian.mn, today.mn for  slander by including   a false text massage in the publication titled as “A pinned woman of G.Batbayar, known as lawyer has threatened to die if a negative information about her is publicized”.  The complaint was considered by the Committee and it’s been concluded that the respective websites have no undertaken insight examinations if the information was relevant to interests and knowledge of the public, not verified the accuracy, focused more on individuals rather than events, have intervened privacy of B.A while using personal identifications such as photo and video on the publication title. Therefore it’s been identified that the respective websites have breached provisions  of Paragraph 1.1  “ Avoid any accidental errors by verifying  accuracy of information”, Paragraph 1.2  “ Prefer quoting a source of information by investigating verification of the source.”, Paragraph 1.3 “Title, photo, video, audio, graphics ,  quotation, shall not cause  any  misrepresentation,  oversimplifying or perversity of any  incidents  out of real  contexts or facts and not  to cause any such breaches.”, The Code of Media Ethics.

Meanwhile today.mn website has apologized and   publicized “a corrected information on its false information to the public which   caused a damage to reputation of B.A” dated   on June 20th on its website, therefore it is regarded as correction of the error and it shall be publicly announced that an infringe has been corrected by itself as stated 6.2. 2 “Complaint handling procedure”.

Eleven of the above mentioned websites have admitted their infringements and provided MMC with apology explanations for the occurred errors and apologies from B.A has been publicized on their websites likewise today.mn therefore MMC sent out official statement to those social medias that since they have undertaken infringement corrections with their responsibilities, these self-recognition of responsiveness shall be known publicly through their means.  

Complaint #6:

G.Batbayar, an individual has complained to MMC on Ugluu.mn, an information website for its libel information which were publicized 9 times from April 7th to June 6th of 2017  that caused damages to his  reputation and business, and  according to his complaint, the contents of information were based on  personal unfavorable communications, revenge, jealousy and rumors and his business reputation and interest have been seriously hurt as a result of repeated libeling.   

The Ethics committee reviewed and considered the case and concluded as “the respective website has not undertaken insight examinations if the information was relevant to interests and knowledge of the public, not verified the accuracy, focused more on individuals rather than events, have intervened privacy of G.Batbayar  while using personal identifications such as photo and video on the publication title

Therefore it’s noted that ugluu.mn, an information site breached provisions Paragraph 1.2  “ Prefer quoting a source of information by investigating verification of the source.”, Paragraph 1.3 “Title, photo, video, audio, graphics ,  quotation, shall not cause  any  misrepresentation,  oversimplifying or perversity of any  incidents  out of real  contexts or facts and not  to cause any such breaches.”, Paragraph 1.6 “ unverified information, assumption and gossip shall be clearly  mentioned as an “assumption”, Paragraph 4.2 “ Unless it’s  proven by a court, nobody shall not be blamed as a guilty.” , and Paragraph 6.2 “Respective identification of a person including  name, photo and other privacy concerned information shall be disclosed only for the  benefits and concerns of the public”,  The Code of Media Ethics. 

Complaint #7.:

G.Batbayar and B.A, individuals have made written complaints to MMC blaming “Notstoi medee”  newspaper for its  publication with reference # 14/648 of May, 2017  and  titled as “ G.Batbayar, known as a lawyer, ‘s pinned woman has threatened him to die if any negative news on her is publicized” . The complaint also said that the newspaper has put the publication with libel and slander contents by having the headline on the cover-page of respective edition, and the publication was intentionally disseminated   through more than 20 websites.  

The Ethics committee has considered the case and concluded that “Notstoi medee”, newspaper has not undertaken insight examinations if the publication concerns interest and knowledge of the public, not verified the accuracy, focused more on a private person rather than an event, breached personal privacy while the title, photo and picture have been used, not provided any opportunity for justification and explanation.  Based on the above mentioned, the MMC noted that  the newspaper has breached provisions  of Paragraph 1.1 “Avoid any accidental errors by verifying  accuracy of information”, Paragraph 1.2  “ Prefer quoting a source of information by investigating verification of the source.”, Paragraph 1.3 “Title, photo, video, audio, graphics ,  quotation, shall not cause  any  misrepresentation,  oversimplifying or perversity of any  incidents  out of real  contexts or facts and not  to cause any such breaches.” , and Paragraph 6.2 “Respective identification of a person including  name, photo and other privacy concerned information shall be disclosed only for the  benefits and concerns of the public”,  The Code of Media Ethics.

Complaint #8:

The last complaint considered by the Ethics committed in the year of 2017 was a complaint made by The national garden park blaming “Bataar.mn” website for its publication dated on September12, 2017 titled as “ A national garden park became a recovery place of dunk people” . The complaint stated that  though “Mongoliin medee” newspaper has been quoted as a source  for publication , “bataar.mn” has not verified the accuracy of information, not reconfirmed the source while  copied  the information, therefore libel, slander, intentional and unjustified information on the entity has been disseminated and the respective reputation is damaged. When “Mongoliin medee”, the original source of this publication has been approached, it has admitted its inaccurate publication and withdrawn the publication from the contracted websites.”  

The Ethics committee considered the complaint and concluded that the publication concerned the knowledge and interest of public, openly  criticized  activities of the National garden park based on real facts, not used any libeling, slandering  or reputation damaged words and expressions  and clearly quoted the source of information. Therefore it is regarded that “Bataar.mn” website has not breached the Code of Media Ethics.
